Suspects Still at Large in Atlanta Allen Hills Apartment Shooting; Victim May Seek to Bring Lawsuit per Atlanta Apartment Crime Attorneys at The Murray Law Firm

Atlanta police are searching for suspects in the Allen Hills Apartments shooting of a 37-year-old man.

Allen Hills Apt Shooting.jpgAccording to police, the victim was smoking outside of his mother's apartment on 81 Allen Temple Court early Tuesday morning [November 27] when two men approached him asking for a cigarette. The victim believed he was about to be robbed and attempted to leave when police say he "was shot twice, once in his mid-torso and once in one of his thighs."

The victim is in stable condition at Grady Memorial Hospital. Investigators found several shell casings at the scene and are currently unsure of the motive. Police say, "They are looking at all angles including robbery." For now, the suspects remain at large, which has left Allen Hills residents wary once again. Cassandra James was killed at the Allen Hills Apartments only three years ago.

Georgia Launches 'Operation Safe Holidays' Driving Campaign

Georgia is poised to mark the first increase in state traffic deaths in more than five years which prompts Tuesday's launch of "Operation: Safe Holidays."

Representatives of the Georgia Department of Public Safety and the Governor's Office of Highway Safety are touring the state to promote safe driving.

"Already, we have surpassed where we were this time last year and we have not even entered the holiday season, our busiest traffic period of the year," Harris Blackwood, GOHS director, said in a news release. "We simply cannot afford to lose another life on Georgia's roads this year."

Blackwood urged motorists to pay attention, avoid distracted and impaired driving and buckle seat belts on every trip.

For the past six years, Georgia highway deaths have been on the decline.

Up until Nov. 15 of this year, 1,013 people died in motor vehicle crashes in Georgia. Without increased safety measures, authorities fear the death toll will exceed that of 2011, when 1,226 people died in motor vehicle crashes in Georgia.

Blackwood and Col. Mark McDonough, commissioner of the Georgia Department of Public Safety, are flying across the state to kick off the safety campaign.

After a 9 a.m. news conference in Columbus, they stop at Albany at 10:15 a.m., the Middle Georgia Regional Airport in Macon at 11:30 a.m. and will stop in Savannah at 1:15 p.m. and Augusta at 2:30 p.m.

McDonough said saving a life can be as simple as buckling a seat belt.

"It's also an effective way to avoid getting stopped by law enforcement on your way home," McDonough said.

Georgia participates in the "Click-it or Ticket" national campaign to enforce seat belt laws and save lives during the Thanksgiving holiday travel period.

The National Highway Traffic Safety Administration reports seat belts saved more than 12,500 lives nationwide in 2010 alone.

Proper seat belt use reduces by 50 percent the risk of moderate to serious injuries. Seat belts also reduce fatal injuries by 45 percent for front seat occupants, according to federal research cited in the news release.

But nearly 50 percent of the confirmed fatalities on Georgia's roads this year were people who were not wearing a seat belt. Nearly 68,000 people across the state were cited for not wearing a seat belt during a 100-day enforcement campaign this past summer.

"Seat belt use is one of the few things we have control over in our lives," Blackwood said. "Neglecting it should never be a factor in our deaths."

Joan Gertrude Steele of Clayton Killed in Cleveland, GA Car Accident; Fatal Accidents Soar During Holiday Travel Season

Steele Accident.jpg81-year-old Joan Gertrude Steele of Clayton was killed in a tragic car accident on Georgia Hwy. 115 Tuesday Nov 19. According to police reports, Ms. Steele was driving her 2010 Ford Focus eastbound on GA Hwy. 115 when a 2003 Dodge Ram pickup truck, driven by William Andrew Daniel of Cleveland, pulled out of The Cottage House Restaurant parking lot, striking Ms. Steele.

Ms. Steele was airlifted to Grady Memorial Hospital where she later succumbed to critical injuries. Mr. Daniel, 54, was treated for injuries at Northeast Georgia Medical Center in Gainesville. Charges are still pending a police investigation.

Just days before Thanksgiving, Ms. Steele's tragic accident occurred at the start of a horrific holiday week of traffic fatalities. Georgia police reported 19 fatal car accidents from Wednesday to Sunday surrounding Thanksgiving. During that time, state troopers investigated 662 traffic collisions with 263 injuries. Alcohol is suspected as a contributing factor in at least 4 deaths. Our hearts and prayers go out to the families of these victims, who lost loved ones on what should have been a joyous week.

Dump Truck Accident Closes Westover Blvd. in Albany, GA

Westover Accident.jpgRush hour traffic was rerouted for over an hour Wednesday morning [Dec 5, 2012] as police responded to a commercial dump truck collision on the northbound side of Westover Blvd., between Old Jim Davis Rd. and West Gordon Ave.

Around 8am, police received reports of a three-vehicle crash involving two tractor-trailer trucks and a small car. However, upon arrival, police found a two-vehicle crash (a commercial dump truck and a silver 2001 Chevy Malibu).

A significant amount of hydraulic fluid spilled during the crash, causing police to barricade the roadway and reroute traffic down Old Jim Davis Road while equipment, sand and trucks were brought in to clean up the oil. Cleanup of the northbound side of Westover is likely to continue over the next 48 hours.

According to Albany police, 23-year-old Robert Gillion was traveling northbound on Westover in his Malibu when he drifted from the roadway. As he attempted to correct himself, he hit the dump truck, puncturing the hydraulic tank. The Malibu sustained significant damage. Thankfully, police report there were no serious injuries.

Albany truck accident attorneys investigating this incident report, as Mr. Gillion appears to be at fault in this incident, the driver of the dump truck may elect to hold him civilly liable for any injuries or damage sustained. Further, as it appears the truck driver was working at the time, he may also be entitled to a substantial worker's compensation claim. Communities Fight Crime by Taking Neighborhood Watch Online

Neighborhood watch groups across the country are banding together through social media to fight crime in their local communities. Lee and Russell Counties of Alabama boast one of the largest neighborhood watch groups on Facebook.

Abbie Hubbell of WTVM reports:

The group creator, Eric Woodson, and six of his friends became concerned about crime in their area and thought of a way to link neighborhoods together through the social media site.

One year later, they are over 8,000 members strong.

"We got together and said we need to bring back this whole neighborhood watch concept. We need neighbors watching out for neighbors, not being afraid to ask questions when you see something strange or suspicious in your neighborhood," explains Woodson.

The group gives tips on recent crimes on a daily basis.

Woodson says he has seen an increase of awareness in citizens, and even law enforcement has taken a close look at this program.

"It is a big information sharing network. It's a clear house for information," Woodson said. "Law enforcement is taking a look at what we're talking about, they're sharing information with us, we're sharing information with them."

This watch group goes beyond crime fighting and also reaches out to help those neighbors in need. For example, when fires recently struck in the Beauregard area, the website reached out for donations for the family who lost everything.

"At a time at the holiday season when people have lost everything, people are giving from the heart and it's just another aspect of the page," said Woodson.

This Facebook page has inspired individual neighborhoods to come together and create their own community watch page, for example, the residents of the Meadowood subdivision.

Adriane Salmi created the page for Meadowood and believes it has been a great way to bring her own neighbors together.

"I thought it would be a good idea to try and connect the community and relay information when something is going on. Everybody is checking on everybody so it's been a great help," explains Salmi.

Cityscape at Midtown Apartment Shooting Leaves One Critically Injured; Apartment Complex May Be Held Liable

A 22-year-old man is in critical condition after being shot during a robbery at the City Scape at Midtown apartment complex just after midnight on Thursday [Dec 6, 2012].

Security Gate.jpgThe shooting occurred at 12:15 am in the parking lot of 300 Cityscape Plaza in Midtown. According to Police Capt. Adam Lee III, two men, believed to be step-brothers, were searching for their parked car at the Cityscape at Midtown apartment complex when two men approached them in what appears to be a robbery.

Witnesses report hearing shots fired and seeing the two attackers flee the scene. Officers arrived to find a man suffering from gunshot wounds to his chest and left arm. He was transported to Grady Memorial Hospital in critical condition. His step-brother was not injured during the attempted robbery.

The gunmen are still at large and local residents are left terrified as this is the second Old Fourth Ward apartment shooting in under a month.

U.S. Department of Labor Reports 171 Workers Compensation Deaths in Georgia

Recent statistics published by the United Stated Department of Labor reveal that workers compensation accidents in Georgia resulted in 171 deaths in 2008. Although this figure appears high, the total number of fatalities was actually down from the prior year. In 2007, there were 193 deaths caused by a work related accident or injury.

For example, further analysis of the workers compensation death statistics offer insight as to the cause of the employee fatalities. The largest category of deaths, 62, were caused by employees involved in a car accidents and truck accidents while working. Motor vehicle accidents were followed by falls at work (28 deaths), heavy equipment/machine accidents (28 deaths), and violent acts and assaults at work (26 deaths). As workers compensation attorneys, we are also interested in which workers are more at risk to sustain a work injury. The statistics evidence that men are disproportionately injured on the job in Georgia, as only 12 of the 171 deaths were women.

One particularly interesting revelation from the 2008 death statistics is that certain ethnic groups are killed at rates that are disproportionate to their representation in the general population. For example, although Hispanics comprise about 8 percent of Georgia's population, they accounted for almost 15% of all workers compensation deaths in 2008.


Sewon America Crane Accident Injures 2 Workers in LaGrange, GA

Two Sewon America, Inc. workers were struck by a crane around 10am Friday morning in LaGrange, GA.

Sewon America.jpgAccording to initial police reports, the workers were doing maintenance work in a basket lift when a crane struck them, overturning the lift with the workers inside. Both Sewon America, Inc. employees were harnessed at the time, but suffered serious injuries. One was taken by helicopter to the Columbus Medical Center and the other was flown to Atlanta Medical Center.

Police have not yet released the names or condition of the injured employees, but sources say one employee was from Alabama and the other from the Atlanta area.

Sewon America supplies automotive parts for Kia Motors Manufacturing Georgia and Hyundai Motor Manufacturing Alabama.

Drivers Urged to Practice Caution As Rain Spreads Across Georgia

rain driving.jpgAs rain continues to stretch over much of Georgia and the Southeast today, our accident attorneys remind drivers to practice extra caution while driving on wet roads. Though weather is often blamed, many of these accidents can be prevented by taking simple precautions on the road.

Edmunds offers the following tips and techniques for driving safely in the rain:

When the road is wet, the film of the water on the asphalt causes tires to lose traction. Less obvious is the fact that rain reduces driver perception -- it's harder to see through the rain -- and also decreases visibility through its action on headlights, windshields and the road itself. While most people know to slow down in the rain, there are definitely other tips that will help keep you, and those who share the road with you, from becoming a statistic.

  • Exercise extreme caution after a long dry spell. During a dry period, engine oil and grease build up on the road over time. When mixed with water from a new rainfall, the road becomes extremely slick. Continued rainfall will eventually wash away the oil, but the first few hours can be the most dangerous.
  • Allow for more travel time. You should plan to drive at a slower pace than normal when the roads are wet. Keep in mind that traffic is likely to be moving slower as well. There's also the possibility that your preplanned route may be flooded or jammed. Whatever the case, rushing equals higher risk.
  • Brake earlier and with less force than you would normally. Not only does this increase the stopping distance between you and the car in front of you, it also lets the driver behind you know that you're slowing down. Also, be more meticulous about using turn signals, so that other drivers know your intentions, and take turns and curves with less speed than you would in dry conditions.
  • Most of America's roads are crowned in the middle, which means that the water will run off to the sides. If possible, stay toward the middle of the road to avoid deep standing puddles.
  • Don't use cruise control. If you hydroplane, there's the chance your car could actually accelerate. Cruise control also allows drivers to be less vigilant and to take their foot away from the pedals -- not a great idea when reaction time is so important.
  • If you see a large puddle up ahead, drive around it or choose a different route. It could be that it's covering a huge gaping maw into the front door of hell. Well, maybe not, but water splashing up into your car's engine compartment could damage its internal electrical systems. Also, a pothole may be hiding under the water, just waiting in ambush to damage a wheel or knock your suspension out of alignment. If you can't gauge the depth, or if it's covering up the side curb, try to avoid it.
  • After you cross a puddle, tap on your brake pedal lightly to dry off some of the water on your rotors.
  • Turn on your headlights, even when there's a light sprinkle. It helps you see the road, and more importantly, it helps other motorists see you. However, don't blast your high beams in the rain or fog -- it'll obscure your view further, as the light will reflect back at you off the water droplets in the air. If your car is equipped with foglights, you may find it helpful to turn these on, as they throw a little extra light on the road while making your car easier to see.
  • Watch out for pedestrians. An ordinarily observant pedestrian may become distracted by fiddling with an umbrella or a rain slicker. Plus, raindrops deaden sound, so the usual audio clues for measuring car distances become obscured. Keep a sharp lookout for people in the road.
  • Defog your windows. Rain will quickly cause your windshield to fog up. Switch on both front and rear defrosters and make sure the air conditioning is turned on. Most cars' climate control systems will automatically engage the A/C when the windshield defrost function is selected.
  • If you start to hydroplane, don't brake suddenly or turn the wheel, or you might spin into a skid. Release the gas pedal slowly and steer straight until the car regains traction. If you must brake, tap the brake pedal (unless you have antilock brakes, in which case you can put your foot down).

Lawrenceville City Employee, Otis Johnson, Seriously Injured by Fallen Tree Limb; Family May Seek Workers' Compensation Claim

Otis Johnson, a 33-year-old Lawrenceville, GA meter service employee, was seriously injured on Monday afternoon after a falling tree limb crushed his city truck.

lawrenceville video.jpgMr. Johnson was driving his city-issued Ford Ranger down the 100 block of Stone Mountain Street, near the Constitution Blvd. intersection, around 1:30pm when strong winds and heavy rain toppled a large oak tree limb onto the roof and windshield of his truck. Mr. Johnson lost control and the vehicle continued through the intersection, crashing into a Chevy pickup truck, which had been involved in another accident only moments earlier.

The Jaws of Life were needed to free Mr. Johnson from his truck and he was rushed to the Gwinnett Medical Center with severe head and facial injuries. Mr. Johnson's family and community have rallied around him in support.

Lawrenceville Mayor Judy Jordan Johnson extended thoughts and prayers to Mr. Johnson's family on Monday, "Our hearts are with Otis Johnson and his family during this time of extreme uncertainty."

Mr. Johnson's brother-in-law, James Horn, reports, "They did surgery last night to remove pressure from his brain and tonight they're doing facial surgery....He's in good spirits and has a lot of family and people to support him and his wife, Mandy."

Multi-Car Accident on I-85 North at North Druid Hills Leaves Four Injured

A multi-car accident on I-85 north shut down multiple lanes and sent at least four people to the hospital just after midnight on Wednesday morning.

Ambulance at Night 300x200.jpgEarly reports indicate that at least four people were injured during the early morning collision, which brought northbound lanes of I-85 to a halt. The accident occurred at North Druid Hills in DeKalb County.

Multiple northbound lanes of I-85 were closed as crews worked overnight to clean up the wreck. The injured victims were taken to area hospitals. Police have not yet released names or conditions of those involved.

Loretta Williams Killed by Pick-up Truck While Walking on Steam Mill Road; Family May Hold Driver Liable

SEE UPDATE: Georgia Legal Report investigators have uncovered more information on the tragic Saturday morning accident, which claimed the life of Loretta Williams and Injured Linda Estell.

Loretta Williams of Columbus, GA was taking a morning walk with friends down Steam Mill Road Saturday when a pick-up truck struck and killed her.

Williams Hit.jpgInitial police reports indicate Ms. Williams was walking down Steam Mill Road around 6:30am Saturday morning [December 15, 2012] when the driver of a pick-up truck fatally struck her.

Ms. Williams' daughter, Aliyah Bri'Ana Williams, told WTVM Channel 9 that her mother was part of a "group of walking buddies...trying to keep a healthy fit life."

Police have not yet released information on the pick-up truck driver.

UPDATE: Loretta Williams Killed, Linda Estell Seriously Injured As School District Truck Strikes Walking Group on Sidewalk

Georgia Legal Report investigators have uncovered more information on the tragic Saturday morning accident which claimed the life of Loretta Williams and seriously injured Linda Estell.

Loretta Williams.jpg50-year-old Columbus resident, Loretta Williams, was walking with friends along Steam Mill Road around 6:30am Saturday morning when a Muscogee school district worker drifted off the roadway, onto the sidewalk, fatally striking Ms. Williams and critically injuring 63-year-old Linda Estell. A third pedestrian, Randall Williams, sustained minor injuries.

According to Columbus police, 45-year-old Alfie Johnson was driving westbound down Steam Mill Road in a Muscogee school district issued Ford F-150 truck when he drifted onto the sidewalk and into a group of pedestrians. The accident occurred on Steam Mill Road, down the hill from the Shirley Winston Park entrance, in front of the Pierce Chapel AME Church.

Randall Williams, a witness and friend of Loretta Williams and Linda Estell, was grazed and bruised by the truck as she pushed another walker, Eddie Ford, out of its path. She described the horrific accident for the Ledger Enquirer, "I could feel the truck behind me...I saw his lights out of my peripheral vision, and I could feel him being real close, and I thought, 'He is too close.' And he was on the sidewalk." The pick-up truck continued into Loretta Williams and Linda Estell, who were walking a few feet ahead. "He hit both of my friends, and they flew about 10 feet."

Loretta Williams and Linda Estell were taken to The Medical Center in Columbus. Ms. Williams succumbed to injuries sustained in the crash and, according to her daughter, was pronounced dead at the Columbus Medical Center at 8:25am. Linda Estell has been transferred from the Medical Center to a long term rehabilitation center in Atlanta, suffering incomplete quadriplegia and partial memory loss.

The four walkers were part of a larger walking and exercise club, which met regularly at the Shirley Winston Park. Friend and fellow walking club member, Geneva Turner, said Loretta Williams was dedicated to her health and exercise. "She was proud of the fact that she had lost so much weight; she had got off diabetic medicine; she was no longer a diabetic."

"She and I walked together, every day, seven days a week, and every day, we would pray....She always would encourage me; I would encourage her. We were a family out there. We took care of one another," recalls Randall Williams.

From a hospital bed, Linda Estell learned about Ms. Williams' death. "Oh my God, Oh my God, she was such a good person. She didn't deserve that." Now, she's asking questions about the man who killed her friend and forever changed her life. She wants to know if Mr. Johnson was impaired or texting while driving.

April Winters, Taneka Ackies, and Infant Niyla Ackies Killed in Christmas Day Car Accident, 4 Others Injured; Families May Hold Apparent DUI Driver Liable

Police Line.jpgThe Georgia State Patrol reported 17 traffic fatalities and 300 injuries over the Christmas holiday weekend, beginning at 6pm Friday evening and ending at Midnight on Wednesday morning. The staggering number is a dramatic increase from 2011.

Impaired driving was listed as a factor in several holiday accidents, including a Christmas day tragedy which claimed the lives of three Cartersville residents, including a 27-day-old infant.

Brent Leighton Lynch of Calhoun has been charged with DUI in the Christmas Day head-on collision, which claimed the lives of three people and injured four others near Mauldin in Gordon County.

According to State Patrol spokesman Gordy Wright, Mr. Lynch was driving his 1996 Ford Bronco eastbound on Georgia Highway 53 after 5:30pm when he drove off the right side of the road. Mr. Lynch then re-entered the road, striking a 2006 Kia Spectra head-on.

The driver of the Kia, 40-year-old April Nacoale Winters, and her two passengers, 21-year-old Taneka Latrice Ackies and 27-day-old Niyla Raine Ackies, were killed. Injured Kia passengers, Alexis Gardner and Ratanza Winters, were taken to Erlanger Medical Center in Chattanooga. Mr. Lynch and his passenger, Crystal Lynch, were also treated for injuries.

Police have charged Mr. Lynch with three counts of first degree vehicular homicide, one count of feticide by vehicle, driving under the influence, driving on the wrong side of the road and failure to maintain lane.

According to police, George Buchanan was crossing a Savannah street around 6:30pm Friday [December 21, 2012] when he was hit by a car. Mr. Buchanan was taken to Memorial University Medical Center where he succumbed to his injuries. The tragic accident was the second pedestrian fatality in only two days.

53-year-old John Robertson was killed by a pickup truck on Thursday night [December 20, 2012]. Savannah police report Mr. Robertson was one of three people hit by cars in Savannah on Thursday. The four separate accidents are still under police investigation and charges against the drivers have not yet been reported.

Edward Yancey Killed in Augusta Nightclub Shooting; Attorneys Question Club Fiasco in Innocent Bystander's Death

Attorneys at The Murray Law Firm are investigating the shooting of 21-year-old Edward Yancey who was killed in the early hours of New Years Day outside Club Fiasco on 2925 Peach Orchard Road in Augusta, GA.

According to Augusta police, an argument which began inside the nightclub was taken outside to the parking lot where it escalated to violence. Police arrived around 2:30am where they found Mr. Yancey dead from an apparent gunshot wound. Investigators report Mr. Yancey was an "innocent bystander" in the shooting and had not been involved in the argument.

Mr. Yancey's friend, Carlysha Golatt, reports Mr. Yancey was "happy" and celebrating the New Years holiday inside the nightclub prior to the tragic shooting. The nightclub closed at 2:00am and the shooting occurred as patrons were leaving the club. Police are searching for suspects and asking any witnesses to come forward.

As the facts of this incident continue to emerge, it may be possible that Mr. Yancey's family would be entitled to a substantial financial recovery for the wrongful death of their loved one. Under Georgia law, a property owner has a duty to keep patrons legally on their grounds safe. For example, if the owner of a nightclub, hotel, apartment, or parking lot has reason to anticipate a criminal act based upon the occurrence of prior similar acts, there is then a duty to exercise ordinary care to guard against any further criminal acts. If the owner fails in this duty by failing to control access to his or her premise, by failing to have adequate security, or by failing to have proper lighting on the property, the property owner is liable to anyone suffers injuries as a consequence.

Legary "Bubba" Antely, Jr. Killed in Smiths Station Construction Accident; Company May Owe Family Significant Compensation for Equipment Failure

Workers' compensation and construction accident attorneys at The Murray Law Firm are investigating the tragic death of Legary Antley, Jr., who was killed in a construction accident just after 4pm on New Years Eve day.

Lee County police responded to a 911 call from a construction site off Summerville Road on Lee County Road 315 in Smiths Station, AL just after 4pm Monday. 29-year-old Legary Antley, Jr. was found dead at the scene.

Officials believe Mr. Antley was working on a dump truck in the raised position, between the dump body and the truck frame. The dump truck hydraulics failed, causing the dump body to fall. Mr. Antley was crushed and killed instantly from massive chest injuries.

Mr. Antley leaves behind his wife, Jessica Antley, and two sons. As Mr. Antley was working at the time of his death and the accident was apparently due to equipment failure, his family will almost certainly be entitled to significant compensation under workers' compensation laws. In addition to compensation available under the workers compensation code, the family may have additional claims against the manufacturer of the dump truck. These machines are designed to be ultra-safe, and the reported failure of the hydraulics system would appear to indicate that there was some form of catastrophic malfunction.
