40-year-old Quentin Thomas, of Tennessee, was struck and seriously injured in an I-75 tractor trailer accident Monday morning, June 9, 2014.
According to the Atlanta Examiner, Mr. Thomas was traveling southbound on I-75, near Sardis Church Road, just after 2:30am Monday morning. A northbound Toyota Camry entered the southbound lanes and struck Mr. Thomas head-on. The tractor trailer erupted into flames. Mr. Thomas was transported to the Medical Center of Central Georgia for serious burns and injuries.
Police believe the Toyota Camry driver was traveling without headlights and under the influence of alcohol at the time of the crash. The driver has been charged with DUI, driving the wrong way on a roadway, driving without headlights at night, serious injury by motor vehicle, and driving on a suspended license.
Our Legal Take
Given the Camry driver’s alleged criminal negligence, Quentin Thomas may elect to hold the driver civilly liable for his injuries. Additionally, as Mr. Thomas was working at the time of his crash, he is almost certainly entitled to substantial workers’ compensation benefits by law. Total compensation may be in the millions of dollars.
Unfortunately, insurance companies and employers are often more concerned with limiting their financial exposure and returning employees to work quickly than the long-term medical care and recovery of a victim. As such, Mr. Thomas should retain a law firm experienced in both catastrophic trucking accidents and workers’ compensation claims without delay to ensure all evidence is preserved and his best interests are protected.
