Kandy and David Buis were killed in a Worth County accident involving a tractor trailer Friday evening, January 24, 2014.

Georgia State Patrol reports a tractor trailer, driven by Brian Keith Sirmons, was traveling northbound on Highway 112 when he failed to stop at the intersection with Highway 133. He drove into the path of a westbound Trailblazer, driven by Kandy Elizabeth Buis, which crashed into the right side of the trailer. Both Mrs. Buis and her husband, David Thomas Buis, perished in the accident.

Attorneys at The Murray Law Firm protect victims of impaired and distracted drivers and are now investigating this tragedy to determine why the truck driver failed to stop:

Tractor trailer drivers are often forced to work extended hours. Was the truck driver impaired by sleep deprivation? Do crime lab results reveal the driver was operating under the influence of alcohol, drugs or medications? Was the driver engaged in distractive devices, such as a cellphone or digital log, when he missed the stop?

Unfortunately, trucking companies often encourage drivers to work perilously long hours to meet deadlines and secure their financial bottom line with little regard to the dangers sleep deprivation imposes on their drivers and those sharing the road with them.

Should the driver in this accident be found at fault for driving over these required rest limits or for driving while distracted or impaired, the family of Kandy and David Buis may elect to hold the driver civilly liable in their wrongful deaths. Further claims may also be filed with the trucking company should unscrupulous policies and negligence have contributed to this tragedy. Of course legal proceedings are of little concern to a grieving family, but such substantial claims are critical in demanding all Georgia trucking companies finally make driver safety a priority over their financial exposure. By holding unscrupulous parties responsible for this tragedy, many other lives may be spared.

Our sincere condolences are with the family of Kandy and David Buis.
