Antwain Clay Killed in Atlanta Apartment Shooting; Investigators Question Security

Police have arrested a suspect in the December 20th shooting of Antwain Clay, killed outside an Atlanta apartment complex on James P. Brawley Drive. Investigators are still questioning whether apartment complex security may have also played a role in the tragedy.

According to Atlanta Police, 27-year-old Antwain Clay was discovered shot and unresponsive on the walkway of the James P. Brawley Drive apartment complex just before 11:00pm Friday evening.

Attorneys at The Murray Law Firm are investigating this shooting and, although they are relieved to learn a suspect is now in police custody, they are questioning whether another party may also hold responsibility in this tragedy, the owner and management of the apartment complex.

  • Was the gunman a resident or guest at the apartment complex and, if not, how did he gain access? Was a security gate and fence in place at the time of the shooting?
  • The shooting occurred on the apartment grounds. Was there adequate, working lighting along all walkways to provide safe entry and exit for all residents and guests? Was a security detail on property at the time of the shooting?
  • Have there been prior assaults on or near property and, if so, what security measures were implemented to protect residents and their guests?

As the details of this shooting continue to emerge, it may be possible that the owner and management of the James P Brawley Drive apartments failed in their duty to protect Mr. Clay. Under Georgia law, apartment owners and mangers have a duty to protect all those residents and guests legally on their premises from foreseeable harm. Should the owner and manager be found at fault in failing to implement property security measures to protect Mr. Clay, his family may elect to hold them civilly liable in his wrongful death. Such a claim may be in the millions of dollars and will, most importantly, demand the James P. Brawley apartments and all other local apartment owners finally make resident and guest safety their first priority.
