A resident of the Terraces of Dunwoody apartment complex was shot and seriously injured on Sunday, August 18, 2013. The shooting is the latest of several recent violent attacks in the area and investigators are now questioning whether a potentially fatal safety lapse at the complex may have contributed to this shooting.
Dunwoody Police were called to the Terraces of Dunwoody apartments around 1:30pm Sunday afternoon for a reported home invasion. Authorities arrived to find a resident shot and seriously injured in his apartment home. Police detectives are reviewing surveillance footage of vehicles entering and exiting during the time of the shooting to assist in their manhunt for a suspect.
The shooting occurred after several recent homicides and home invasions in the area, including one outside a Norcross apartment complex only weeks ago.
As local authorities continue their search for a gunman, attorneys at The Murray Law Firm are questioning whether a potentially fatal security lapse at the apartment complex may have contributed to this vicious attack.
- The shooting reportedly began as a home invasion. With several violent home invasions recently reported in the area, what steps did Terraces at Dunwoody take following the prior incidents to increase security on property and prevent similar violent break-ins?
- Was the gunman a resident of Terraces at Dunwoody and, if not, how did the attacker gain entry to the apartment complex? Was the security access gate working at the time of the shooting and was the security fence intact, particularly in areas backing to side access roads and commercial parking lots?
- Was a fully staffed security patrol monitoring the complex at the time of the shooting and, if so, where were they during the attack?
Police are reviewing surveillance footage of vehicles entering and exiting the property. Was a security detail monitoring these cameras at the time of the attack and, if so, why did they fail to note a suspicious vehicle entering or leaving the property? If the attacker came in by foot, what areas of the property perimeter were left unsecured to allow access?
As the details of this shooting continue to unfold, it is possible the Terraces at Dunwoody apartment complex failed to undertake measures to protect their residents. Georgia property owners are required by law to protect those legally on their premises from any foreseeable risks. For example, should the owner of an apartment, hotel or parking lot have knowledge of prior crime in or near the area, they have a legal obligation to take measures to prevent such violence from occurring on their property. Should the owner and management of an apartment complex fail to take proper safety measures, they may be held civilly liable for any injuries or deaths that occur on their property.
Given the recent violence and home invasions near the Dunwoody area, the Terraces at Dunwoody should have increased security measures to protect residents and deter such crimes on their property. Should The Murray Law Firm discover the owner and management failed to take such precautions, the victim in this shooting may elect to hold the complex liable for his serious injuries. Such a claim could be in the millions of dollars and would, most importantly, serve to demand other local property owners to make resident safety and security their first priority.
As insurance companies and unscrupulous property owners are often more concerned with limiting their own financial exposure than providing victims and families with what they rightfully deserve, we urge the victim in this incident to retain a law firm experienced in both premises liability and personal injury without delay. Photographs and a thorough inspection of the property will need to be performed immediately before any evidence may be destroyed or repaired. The Murray Law Firm has extensive experience in protecting victims of apartment crimes, such as this, and we offer our legal expertise, if needed.
