Could the senseless death of Sean Mobley have been prevented and are justice and compensation available to Mr. Mobley’s family?

Gunfire erupted “early Saturday outside the Hole In The Wall bar located off Peachtree Road,” WSBTV.com is reporting.  According to AJC.com, “[p]olice believe an argument led to the gunfire, and [a male victim] was shot in his torso and arm….”  The news outlet reports that he was transported to “Grady Memorial Hospital” where he was tragically unable to recover from his injuries.  Fox5Atlanta.com is reporting that “[f]amily members identified the man killed as 28-year-old Sean Mobley.”

The suspects fled from the scene “in a burgundy Nissan Altima and hit several cars in the parking lot as they took off'” according to Fox5Atlanta.com.  They have apparently not yet been identified.

Bar patrons have a right to feel safe and secure while on the premises of the establishment they are visiting.   • Have there been prior incidents of violence on or near the property?
  • Was bar security or management aware of the initial altercation, and were efforts made to safely and separately remove all parties involved from the premises?
  • Was security present and were police called at the start of the initial altercation?
  • What additional security measures, such as bright lighting and visible surveillance cameras, were in place to deter crime and protect Mr. Mobley at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that property owners, tenants, or management failed to provide adequate security to protect those on the premises, Mr. Mobley’s family may seek justice and elect to pursue legal claims for their loss.
